We succeeded in an appeal against a refused planning application and conservation area consent for the demolition of a garage and proposed two storey side extension incorporating a double garage and a granny flat.
This was a challenging appeal. The Council refused the application for three reasons: the loss of an important gap to the Wandsworth Common Conservation Area; that the design was out of character and would harm the appearance of the Conservation Area; and the impact on the living conditions of adjoining properties, with particular reference to outlook.
Collaborating with the Architect (Michael Evans), we successfully demonstrated to the Inspector that the gap did not make a significant contribution to the character of the Conservation Area and that such infill development has occurred in the locality without harm to the Conservation Area. We also established that the design intention was to preserve and enhance the streetscape and that the Council’s criticism on the design was subjective. The Inspector agreed with our case that the separation distances were adequate, so there would be no harmful effect on outlook.
