terms of appointment
Before commencing any work, unless instructed to the contrary, we will set out in writing the issues that need to be addressed in order to achieve your objectives; the work that we would do and the costs involved.
We shall carry out work using all reasonable skill, care and diligence. Whilst reasonable care would be taken in relation to the accuracy and practicality of proposed solutions, we cannot guarantee the accuracy of Ordnance Survey, land ownership or other plans supplied to us by others or the accuracy of solutions based on such plans. Neither can we guarantee that planning permission will be forthcoming where planning applications and appeals are involved.
All fee prices quoted are exclusive of VAT. We would wish to reserve the right to alter fee proposals should it become evident that our brief has altered significantly during the course of the work. Should this be necessary, we will discuss what work needs to be done and seek your agreement about the likely cost.
Unless otherwise stated, our fees for work are determined on the basis of time actually spent on the project. We are prepared to discuss alternative fee arrangements, for example entailing budget ceilings or reduced fees supplemented by a performance bonus as a result of a successful outcome (to be defined after agreement).
We shall endeavour to keep our fees to levels that are reasonable and commensurate with the work that we consider necessary to achieve the objectives that have been agreed with you. We would keep you advised of any budget revision that may be foreseen as work progresses. We would not exceed the budget estimate, if one had been agreed, without prior approval.
Fee rates are related to type and quantity of work, staff designation and experience.
Fee rates are exclusive of out-of-pocket expenses incurred in connection with the work. These include maps, plans and documents; travel; printing, copying, faxing, postage, e-mail and internet; photography, couriers, parking, accommodation, subsistence; Counsel’s fees; specialist reports (e.g. telephone surveys or demographic and expenditure assessments and other bought-in services). Time spent travelling in connection with the work is chargeable.
Our accounts are subject to VAT and are payable within 10 calendar days of presentation.
We reserve the right to levy interest for sums remaining unpaid for unusually long periods.
Work for clients with whom we have never worked previously will be subject to the prior payment of a New Client Protocol Fee of £600 (including VAT), which amount will be discounted from the sum total of the first account invoice issued.
